Terms & Conditions of Business - O'Neill Surf Aademy operated by West Coast Surfari
These are the terms and conditions upon which O'Neill Surf Academy/West Coast Surfari and any person or persons (the client) applying to book a surf lesson, course of holiday agrees to adhere to:
THE BOOKING
When booking a surfing course, lesson or holiday with the O'Neill Surf Academy/West Coast Surfari, a contact is made when the booking is confirmed in writing or email by us. In the case of telephone bookings when a written confirmation is not possible the agreement is a verbal contact.
We require a minimum of 2 people to run any O'Neill Group Surfing Course. Please be aware that when booking a course that your lesson may be rescheduled or rearranged to suitably accommodate you within a group setting.
ONLINE BOOKINGS: Booking can be made on our online booking system, with full payment required to reserve your place/s at the time of booking. All online bookings require full payment at the time of booking.
TELEPHONE BOOKINGS: Full Payment OR a Non-Refundable Deposit is required to reserve your place/s at the time of booking. In cases of full payment 50% of the total amount is held as your non-refundable deposit amount.
SPECIAL OFFERS: All surfing lessons and courses booked under 'special offer' at a reduced rate are subject to our non-refundable/non-tranferable terms. All online special offers published on our website cannon be used in conjunction with any other oneill offers. Full payment is required for all sepcial offer bookings. Bookings are always subject to availability.
The person making the booking accepts responsibility for the payment of everyone on their booking and is responsible for ensuring that all other persons on the booking have read our Terms and Conditions and are aware of all the booking details.
All remaining balances must be paid on the date of the trip, or no later than 7 days of the date of invoice. The O'Neill Surf Academy/West Coast Surfari charge all outstanding accounts at 2.5% interest for every 7 days thereafter.
Any non paid "No Shows" will have their remaining balance charged to credit/debit card on file.
WHEN A BOOKING IS MADE:
- You will receive confirmation of you booking via email, post of text message. If you receive your confirmation by email please print it off and bring it along with you to your course.
- Gift Vouchers: When a lesson is booked using a Gift Voucher or Gift Experience, once the lesson is booked and confirmed by us no changes are permitted. Gift voucher booking are non refundable and non tranferable. Please ensure that the date/s and time/s that you book are suitable for your requirements and are correct at time of confirmation.
- The balance specified in the confirmation will be collected on arrival to your course, or can be paid in advance by contacting our office for card and e-payments. Preferred method pf payment at the beach is cash or cheque as we do not have a card facility at this location.
- For groups of 5 OR MORE people the balance will be collected 10 days before the lesson start date.
CHANGING YOUR BOOKING:
The O'Neill Surf Academy / West Coast Surfari will make every effort to arrange any changed requested after the booking hass been made and confirmed (excluding Gift Voucher/Experience bookings where changes are not permitted). Any changes are subject to our availability of course dates, places available and instructor availability.
In a case where your group size drops in number from the original booking notification of this must be sent in writing. Decreases in numbers in attendance of orginal booking less than 21 days before lesson start date will be responable for the payment of the balance of the original booking.
If you would like to bring additional guests, please notify us at least 14 days in advance of your course date. We cannot guarantee that additional spaces will be available unless booked in advance. Due to the nature of our business, weekends, school holidays and peak season is always busy and early booking is advised.
CANCELLATIONS:
All cancellations must be sent in writing /email to info@oneillsurfacademy.co.uk or O'Neill Surf Academy, Trevose Head, St Merryn, Padstow, Cornwall PL288SL and are effective upon the date received by by The O'Neill Surf Academy/West Coast Surfari.
Cancellation charges are payable as follows:
A service charge of £20 is applied to ALL cancellations.
- Cancellations less than 21 days before course start date: 100% of course cost is payable.
- Cancallations made prior to 21 days before course start date: Loss of non refundable deposit.
If any members of your group are not going to participate in the course, lesson or holiday their space must be cancelled following the procedure above. Any non paid "no shows" will be charged to the credit or debit card on file.
Failure of any member of your group to attend their surfing course without prior cancellation will result in the full payment as stated in the confirmation ebing due.
if you're late we won't wait! Failure to turn up to your lesson at the appropriate time will not entitle you to a full or patrial refund. Any late arrivals will be charged the final balance payment (if one is due), and this will be collcted from the credit/debit card on file.
We reserve the right to refuse clients who turn up late for their course (once the students have departed our base and beach lesson has commenced) No refunds are offered in this situation. Participation in a course will require re-booking.
SURF LESSONS:
O'Neill Surf Academy/West Coast Surfari reserve the right to change the venue or cancel the lesson or course due to unsuotable conditions.
In the rare event that we consider the sea or weather conditions unsuitable for instruction we will either:
- Your lesson/s will be arranged for a more approprite date/time or location.
- A credit voucher or online code will be issued.
PLEASE NOTE: We do not issue refunds.
Any credit voucher or online code issued by the O'Neill Surf Academy/West Coast Surfari must be used within the allocated timeframe given. All vouchers are dated and signed off by our head coach on the day. Any owed lesson/s must be booked in advance and are subject to availability.
O'Neill Surf Academy/West Coast Surfari accept no responsibility for students in or beyond the surf line. All care is taken to ensure student safety. All participants will be expected to listen to and adhere to all instructions and advise given by O'Neill Surf Academy/West Coast Surfari staff at all times.
We will refuse to teach any student/particpant who is under the influence of alcohol or substance, or appears in no fit state to take part. This decision is made by the head coach on the day No refunds are offered in this situation.
Students are required to sign a medical declaration prior to surfing and are responsible for ensuring all details are correct. Parents/Guardians of particapants aged 18 or under will be required to sign their declaration and release from and stay within the beach vicinity at all times during the lesson.
ACCOMMODATION:
Our Surf 'n' Stay accommodation is provided the Atlantic Heights Surf Lodge, Watergate Bay. The Atlantic Height Surf Lodge is a privately owned establishment.
O'Neill Surf Academy/West Coast Surfari does not make any claims as to teh standard or arrangement of the accommodation and facilities, nor accepts any responsibility for any problems that may arise during your stay. Any problems must be directed to and delat with the accommodation provider, Mrs Jay Laytham-Byrne directly.
SURF 'N' STAY BOOKING AND CANCELLATION:
Bookings for Surf 'N' Stay courses can be made via the O'Neill Surf Academy/West Coast Surfari booking office. The accommodation will be reserved alongside your surfing cours enad confirmation will be sent in the usual manner (as stated above). A non-refundable deposit is required for all surf 'n' stay bookings.
CANCELLATION:
- Cancellations less than 21 days before course start date: 100% of course cost is payable.
- Cancallations over 21 days before arrival date will incur a cost of 20% of the remaining balance, outside of the deposit which is non-refundable.
If any group members are not going to turn up for their surf 'n' stay course their place must be cancelled following our usual cancellation procedue (as stated above).
Failure to turn up to your accommodation without prior cancllation will result in any remaining balance being collected from the credit/debit card on file with immediate effect.
FOR ALL COURSES, LESSONS AND HOLIDAYS WHETHER IN THE UK OR ABROAD, YOU ARE ADVISED TO TAKE OUT YOUR OWN PERSONAL INSURANCE FOR CANCELLATION, TRAVEL, ACCIDENT, PERSONAL BELONGINGS AND PROPERTY BEFORE YOUR ARRIVAL.
Participation Liability and Other Important Information
Please do not bring valuables to the beach. We do not accept any responsibility for loss or damage to personal items.
The activity of surfing brings with ita degree of risk to both peopel and personal property, even if enjoyed under the proper supervision of qualified and experience instructors. Surfing is a physical and strenuous activity that requires those taking part to have a reasonable standard of swimming ability (50 meteres) and personal fitness. All course/lesson atendees must therefor disclose any medical conditions, illnesses, alergies of physical impairmentsor prescription medication thay required upon sign-in.
You should not participate in a surf course or lesson if you are suffering from any heart condition or if you are pregnant. If you are unsure as to whether your condition will affect your ability to surf we advise you seek medical advise before booking your course. All course members must not be under the influence of substance or alcohol at the time of the lesson which may adversely affect their mental/physical abilities.
All course members must agree to abide by all instructions and decisions that O'Neill Surf Academy / West Coast Surfari staff and instructors make to ensure the safety and wellbeing of all particpants.
Students attending surf courses and lessons will be entitles to use our surfing equipemnt during their lessons. Whereas O'Neill Surf Academy / West Coast Surfari takes all reasonable measures to ensure that equipment is safe and in good condition for use, course members are responsible for immediatly reporting any damage cause to the equipment, or that becomes apparant whilst the equipment is in their posession.
O'Neill Surf Academy / West Coast Surfari does not seek to limit or exclude any liability for personal injury or loss of life which may occour as a result of its own negligence or that of its employees, officeers of agents. O'Neill Surf Academy / West Coast Surfari assumes no liability in respect of any personal injury, loss, damages, concequential loss or third party claims which occur though no faults of its own, employees, officers or agents.
All other liability or conditions implied by law and excluded to the fullest extent possible.
BROCHURE AND WEBSITE ACCURACY:
We make every attempt to ensure that our brochures and website show our customers the services that are on offer at The O'Neill Surf Academy / West Coast Surfari.
All information provided is given as a guide, We accept no reponsibility for errors, ommisions or discrepencies in our literature. All prices are accurate at time of print or publication, but are subject to change. We reserve the right to increase or decrease prices any time after publication. Any alterations or changes will be made clear at time of booking.
